R E G U L A M I N POBYTU GOŚCI I KORZYSTANIA Z OBIEKTU „W MATULNIKU” Witamy Państwa serdecznie w naszym domu i życzymy miłego pobytu. Będziemy wdzięczni za przestrzeganie zasad zawartych w niniejszym Regulaminie, który ma służyć zapewnieniu spokoju i bezpieczeństwa naszych gości. § 1 POSTANOWIENIA OGÓLNE 1. Niniejszy Regulamin określa warunki pobytu wszystkich gości/najemców (dalej łącznie jako „Gość”) w Obiekcie w „W MATULNIKU”, oraz zasady korzystania z obiektu. 2. Zawarta umowa obejmuje tylko i wyłącznie najem obiektu „W MATULNIKU”. Obiekt przeznaczony jest maksymalnie dla 15 osób. 3. Rezerwacja Obiektu następuje za pośrednictwem maila lub telefonicznie 4. Gość nie otrzymuje faktury za pobyt w Obiekcie od Wynajmującego. 5. Podstawą do przekazania Obiektu jest okazanie dokumentu tożsamości Gościa i osób objętych jego rezerwacją. 6. O ile strony nie ustaliły inaczej, podczas przekazania Obiektu klucze, informacje o wyposażeniu i sposobie użytkowania urządzeń znajdujących się na terenie Obiektu przekazywane są przez właściciela lub upoważnioną przez niego osobę lub umieszczone w skrytce do ktorej kod podaje przed przyjazdem Goscia wlasciciel. W przypadku utraty, zgubienia bądź zniszczenia kluczy, Gość jest zobowiązany do uiszczenia opłaty dodatkowej w wysokości 500,00 złotych. 7. Apteczka pierwszej pomocy znajduje się w pokoju głównym, do którego wszyscy mają dostęp. § 2 KORZYSTANIE Z OBIEKTU 1. Z Obiektu mogą korzystać wyłącznie osoby które dokonały rezerwacji . Zabrania się nocowania większej ilości osób niż zadeklarowano w Umowie. 2. Przez cały czas pobytu na terenie Obiektu dzieci poniżej 13 lat muszą znajdować się pod stałą opieką i nadzorem osób dorosłych. Za zachowania dzieci, w tym poczynione uszkodzenia i lub szkody odpowiadają opiekunowie prawni dzieci. 3. O ile strony nie ustaliły inaczej, na terenie Obiektu może przebywać max 4 psy 4. Z uwagi na rodzinny charakter Obiektu, Wynajmujący nie wyraża zgody na organizację przez Gościa przyjęć, imprez czy spotkań większej ilości osób niż zadeklarowanej przy rezerwacji Obiektu, w szczególności wieczorów kawalerskich i panieńskich. Za złamanie tego zakazu Gość zobowiązany będzie zapłacić Wynajmującemu karę umowną w wysokości 2.000,00 zł (dwa tysiące złotych) za każde takie naruszenie ww. zakazu. 5. Prosimy o niezakłócanie spokoju sąsiadów Obiektu oraz przestrzeganie ciszy nocnej 6. Gość zobowiązany jest do natychmiastowego poinformowania o szkodach wyrządzonych przez niego lub osoby, za które odpowiada, a także za szkody spowodowane przez zwierzęta przebywające w Obiekcie. Gość zobowiązany jest także niezwłocznie poinformować Wynajmującego o szkodach które stwierdził na terenie Obiektu, a nie wyrządzonych przez niego, w przypadku nie powiadamiania o takich szkodach ponosi on za nie pełną odpowiedzialność na zasadzie ryzyka w momencie ich stwierdzenia przez Wynajmującego. Goście Obiektu ponoszą odpowiedzialność materialną za wszelkiego rodzaju uszkodzenia, zagubienie lub zniszczenie przedmiotów wyposażenia i urządzeń technicznych powstałych z ich winy lub z winy odwiedzających osób. 7. Gość zobowiązuje się korzystać z Obiektu zgodnie z jego przeznaczeniem, dbać o jego stan techniczny, utrzymywać Obiekt w należytym stanie, dbać o zachowanie zasad dobrego sąsiedztwa oraz stosować się do porządku domowego. Gość zobowiązany jest do przestrzegania porządku obowiązującego na terenie ogrodu, obejścia i użytkowania ich zgodnie z przeznaczeniem (rośliny, sprzęt). Goście Obiektu proszeni są o nie chodzenie po salonie, antresoli i pomieszczeniach sypialnych domu w butach użytkowanych na zewnątrz lub butach na wysokim obcasie. 8. Prosimy o pozostawienie domu po pobycie w stanie uporządkowanym jak w chwili zameldowania, za wyjątkiem śladów kulturalnego korzystania. W przypadku pozostawienia Obiektu w stanie wymagającym ponad standardowego sprzątania, aby przywrócić go do stanu jak w chwili zameldowania, Wynajmujący uprawniony jest do obciążenia i dochodzenia od Gościa opłaty dodatkowej za sprzątanie. 9. Odpady komunalne winne być przez Gościa segregowane. 10. Zlew nie jest wyposażony w młynek. Zakazuje się wyrzucania resztek jedzenia do zlewu. Resztki jedzenia powinny być zabezpieczone i wyrzucone w sposób nieumożliwiający dostęp zwierząt. 11. Gość zobowiązuje się do nie zabierania z Obiektu jakichkolwiek elementów jego wyposażenia. 12. Wewnątrz Obiektu obowiązuje całkowity zakaz palenia tytoniu oraz e-papierosów we wszystkich pomieszczeniach z wyłączeniem miejsc do tego przeznaczonych na zewnątrz budynku. Za złamanie zakazu obowiązuje kara w wysokości 1.000,00 PLN za każdy przypadek naruszenia zakazu, plus ewentualne koszty wymiany elementów wyposażenia i wykończenia Obiektu przesiąkniętych dymem. 13. Każdorazowo opuszczając Obiekt w czasie pobytu, Gość jest zobowiązany do jego zabezpieczenia poprzez zamknięcie drzwi wejściowych, balkonowych oraz okien, a także poprzez wyłączenie płyty grzewczej, piekarnika i innych pracujących urządzeń elektrycznych. 14. Goście mają obowiązek ścisłego przestrzegania przepisów i zasad przeciwpożarowych. W domu znajduje się kominek. Należy zawsze używać kominka zgodnie z przeznaczeniem. Drzwiczki kominka muszą być zawsze szczelnie zamknięte. Zabronione jest pozostawienie kominka bez nadzoru. 15. W trakcie pobytu Gościa na trenie Obiektu usługi sprzątania lub uzupełniania środków chemicznych i toaletowych nie są wykonywane. 16. Obiekt wyposażony jest w bezprzewodowy dostęp do Internetu – Wi-Fi. 17. Gość powinien korzystać ze sprzętu AGD, jak i innych urządzeń zgodnie z ich przeznaczeniem, przy zachowaniu ogólnych zasad bhp. 18. Parking jest przeznaczony tylko dla Gości. Parking jest bezpłatny oraz niestrzeżony. Wynajmujący nie ponosi odpowiedzialności za pojazdy oraz mienie w nich pozostawione. Obiekt nie jest wyposazony w ladowarke do aut elektrycznych i nie akceptuje ładowania aut prądem z obiektu- chyba ze strony uzgodnia inaczej. Za złamanie tego zakazu Gość zobowiązany będzie zapłacić Wynajmującemu karę umowną w wysokości 200,00 zł (dwiescie złotych) za każde takie naruszenie ww. zakazu. 19. Obiekt jest monitorowany z zewnątrz. 20. Na terenie Obiektu grillowanie jest dozwolone, oraz ognisko jest dozwolone wyłącznie w miejscach do tego wyznaczonych (grill, palenisko). 21. Zabrania się pozostawiania rozpalonego grilla lub paleniska bez nadzoru, po zakończonym grillowaniu lub ognisku należy uprzątnąć palenisko. Drewno dostępne jest na terenie Obiektu odpłatnie zgodnie z zasadami określonymi w pkt. 28 poniżej. Użytkownicy grilla zobowiązani są do pozostawienia czystości po zakończonym grillowaniu. Zakaz jest używania grilla pod pergolą lub przy elewacji domu. Goście zobowiązani są do zakręcenia butli gazowej po każdym użytkowaniu grilla. W przypadku braku gazu, butlę gazową wymienia WYŁĄCZNIE gospodarz na wniosek Gościa. 22. Za zniszczenia, zagubienie elementów wyposażenia Obiektu lub basenu Gość ponosi pełną odpowiedzialność odszkodowawczą. W przypadku kiedy kary umowne zastrzeżone w niniejszym Regulaminie nie pokrywają pełnej szkody, Wynajmujący uprawniony jest do dochodzenia odszkodowania uzupełniającego na zasadach ogólnych. 23. W przypadku rażącego naruszenia przez Gościa zasad Regulaminu Wynajmujący jest uprawniony do odstąpienia od umowy ze skutkiem natychmiastowym. W takim wypadku Gość zobowiązany jest do niezwłocznego opuszczenia Obiektu. Wszelkie opłaty w tej sytuacji nie podlegają zwrotowi. 24. Wynajmujący nie ponosi odpowiedzialności za pozostawione w pokojach i na terenie Obiektu rzeczy/minie Gości, w szczególności za przedmioty wartościowe. 25. Wynajmujący nie ponosi odpowiedzialności za przejściowe niedogodności występujące u niezależnych dostawców spowodowane np. czasowym brakiem prądu, Internetu, telewizji. 26. Wynajmujący nie ponosi żadnej odpowiedzialności za szkody majątkowe lub osobiste poniesione przez Gościa lub osoby trzecie w trakcie realizacji umowy, powstałe z przyczyn, za które Wynajmujący nie ponosi odpowiedzialności zgodnie z przepisami prawa powszechnie obowiązującego. W zakresie dopuszczalnym przez przepisy prawa, łączna odpowiedzialność Wynajmującego za szkody Gości i osób trzecich ograniczona jest do szkody rzeczywistej i nie może łącznie przekroczyć kwoty wynagrodzenia Wynajmującego za pobyt Gościa/ów na terenie Obiektu. 27. Wynajmujący wskazuje, iż Obiekt oraz elementy wyposażenia i architektury drewnianej, w tym pergole, wykonane zostały z naturalnego drewna i możliwe są miejscowe wycieki żywicy. Wynajmujący zwraca uwagę na powyższy naturalny, niezależny do Wynajmującego efekt oraz wskazuje na konieczność uważnego korzystania przez Gości z architektury zewnętrznej i pergoli. Odpowiedzialność Wynajmującego za szkody Gości związane z wyciekiem żywicy, w szczególności zabrudzeniem mienia (ubrań itp.), jest wyłączona w całości. 28. OPŁATA ZA DREWNO KOMINKOWE LUB DO PALENISKA. Do dyspozycji gości udostępniamy nieodpłatnie 2 przygotowane kosze z drewnem. Każdy kolejny wykorzystany kosz z drewnem podlega dodatkowej opłacie w wysokości 50 złotych. Drewno do pobrania w drewutni przy budynku. § 3 KORZYSTANIE Z BASENU 1. W okresie od 1 czerwca do 30 Września korzystanie z basenu jest nieodpłatne i możliwe 24h/dobę. Basen jest niestrzeżony. Gość korzysta z basenu na własną odpowiedzialność i ryzyko, a osoby niepełnoletnie korzystają z basenu tylko pod stałym nadzorem swoich pełnoletnich opiekunów. Wynajmujący nie ponosi odpowiedzialności za dzieci pozostające na terenie Obiektu i basenu bez opieki. W basenie całkowitą odpowiedzialność za dzieci oraz młodzież do 18-tego roku życia ponoszą rodzice bądź opiekunowie. 2. Wynajmujący nie bierze odpowiedzialności za urazy lub uszczerbek Gościa na zdrowiu powstałe w skutek korzystania z basenu. 3. Przed wejściem do basenu oraz rozpoczęciem korzystania z basenu należy zapoznać się z niniejszym regulaminem oraz stosować się do niego podczas całego okresu korzystania z basenu. 4. Na basenie obowiązuje całkowity zakaz: a) wnoszenia opakowań i naczyń szklanych, ostrych narzędzi oraz innych, przedmiotów niebezpiecznych, b) wnoszenia, spożywania i podawania artykułów żywnościowych, napojów alkoholowych, narkotyków oraz innych środków odurzających, psychotropowych itp. c) przebywania zwierząt, d) przebywania osób, po spożyciu alkoholu, narkotyków lub innych środków odurzających, e) biegania po obejściach, dojściach i wpychania do wody innych użytkowników, skakania do wody, f) wchodzenia na balustrady, obramowanie basenu oraz urządzenia o innym przeznaczeniu, g) niszczenia i uszkadzania basenu i wyposażenia, w szczególności demontażu lub rozkręcania elementów basenu (profili) lub filtracji, h) wrzucania do wody naczyń, resztek jedzenia i wszelkich przedmiotów obcych, i) zakazuje się żucia gumy w basenie, j) zanieczyszczania wody basenowej, k) wykonywania zabiegów kosmetycznych, l) używania urządzeniach elektrycznych, m) palenia tytoniu, n) nieobyczajnego zachowania, bądź zachowania uznanego powszechnie za nieprzyzwoite lub obraźliwe, o) korzystającym z basenu nie wolno powodować sytuacji zagrażających bezpieczeństwu osób tam przebywających. 5. Głębokość basenu wynosi 150 cm. 6. Wchodzenie i wychodzenie z basenu dozwolone jest wyłącznie przy użyciu drabiki. Jednoosobowo. 7. Przed wejściem do basenu należy zdjąć klapki, okulary, oraz wszystkie przedmioty metalowe mogące uszkodzić folię basenową. 8. Każdy użytkownik basenu jest zobowiązany do umycia całego ciała przed wejściem do basenu. 9. Zabrania się korzystania z basenu osobom, u których oznaki wskazują na: choroby skóry, grzybicy, brodawczaka, rumień, róża itp., otwarte skaleczenia, choroby zakaźne, trudno gojące się rany, brak higieny osobistej, padaczki, czyste iniekcje dożylne na kończynach górnych, trudności w oddychaniu, zaburzenia równowagi, agresywne zachowanie, są uczulone na środki dezynfekujące, chlor lub chemię basenową, posiadają choroby układu wydalania, cierpią na choroby związane z niewydolnością układu krążenia, z przeciwskazaniami lekarskimi. 10. Osoby o niestabilnym stanie zdrowia i kobiety w ciąży powinny korzystać z basenu ze szczególna ostrożnością (lub po skonsultowaniu się ze swoim lekarzem). 11. Wynajmujący nie ponosi odpowiedzialności za konsekwencje zdrowotne przebywania tych osób na basenie. 12. Ewentualne uwagi dotyczące basenu należy natychmiast zgłosić Wynajmującemu. 13. O każdej sytuacji zagrażającej bezpieczeństwu w basenie oraz jego uszkodzeniu należy niezwłocznie powiadomić Wynajmującego. 14. Wynajmujący nie odpowiada za wypadki spowodowane nieprzestrzeganiem regulaminu basenu § 4 RODO Zgodnie z art. 13 ust. 1 i ust. 2 Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych (dalej RODO) informujemy, że: a) Administratorem danych osobowych Gościa jest Marta Piętka, adres do doręczeń 36-030 Błażowa, ul. Futoma 759B, Polska. b) dane osobowe Gościa przetwarzane będą: • w związku z wykonywaną umową, w celu świadczenie usług, na podstawie art. 6 ust 1 lit. b) RODO, • w związku z systemem monitoringu wizyjnego – zapewnienia bezpieczeństwa osób i mienia na terenie Obiektu, na podstawie art. 6 ust 1 lit. f) RODO. c) Dane będą ujawniane wyłącznie upoważnionym do przetwarzania danych osobowych podmiotom obsługującym administratora lub jego podwykonawcom oraz odbiorcom uprawnionym na podstawie przepisów prawa. d) dane osobowe Gościa będą przechowywane przez okres: • w związku z wykonywaną umową tj. świadczenie usług – przedawnienia roszczeń z tytułu wykonywanej umowy, • w związku z systemem monitoringu wizyjnego przez okres 30 dni. e) Gość posiada prawo dostępu do treści swoich danych oraz ich sprostowania, usunięcia, ograniczenia przetwarzania i przenoszenia, a także prawo do wniesienia sprzeciwu wobec przetwarzania i cofnięcia zgody na przetwarzanie danych w dowolnym momencie bez wpływu na zgodność z prawem przetwarzania, którego dokonano na podstawie zgody przed jej cofnięciem. W celu skorzystania z ww. uprawnień należy przesłać wniosek w formie pisemnej lub elektronicznej na adres administratora danych l f) Administrator zrealizuje wskazane prawa, jeżeli nie będą istniały okoliczności uprawniające Administratora do ich przetwarzania, o czym zostanie Gość poinformowany. g) Gość ma prawo wniesienia skargi do organu nadzorczego, gdy uzna, iż przetwarzanie jego danych osobowych narusza przepisy z zakresu ochrony danych osobowych. h) Podanie przez Gościa danych osobowych jest dobrowolne, jednakże niezbędne do realizacji ww. celu przetwarzania. i) Dane Gościa nie będą przekazywane do państw trzecich, nie będą też przetwarzane w sposób zautomatyzowany. § 5 POSTANOWIENIA KOŃCOWE 1. Zapoznanie się z zasadami obowiązującymi w Obiekcie jest obowiązkiem każdego Gościa. 2. Nieznajomość tych zasad nie zwalnia od ich przestrzegania. 3. Regulamin obowiązuje bez wyjątku wszystkich przebywających na terenie Obiektu. 4. Regulamin jest dostępny do wglądu w salonie ogólnodostępnym. 5. Dokonanie rezerwacji jest równoznaczne z akceptacją powyższego regulaminu. 6. W sprawach nieuregulowanych zastosowanie mają przepisy kodeksu cywilnego. 7. Wszelkie spory związane z korzystania przez Gościa z Obiektu rozstrzygane będą przez sąd powszechny w Katowicach, wg. polskiego praw procesowego. R E G U L A T I O N S GUESTS’ STAY AND USE OF THE FACILITY „IN THE MATULNIK” We welcome you warmly to our house and wish you a pleasant stay. We would be grateful if you would abide by the rules contained in these Terms and Conditions, which are intended to ensure the peace and safety of our guests. § 1 GENERAL PROVISIONS 1. These Regulations specify the conditions of stay of all guests/tenants (hereinafter referred to as the „Guest”) in the facility „W MATULNIKU”, and the rules of using the facility. 2. The concluded Agreement comprises only the renting of the facility „W MATULNIKU”. The facility is intended for a maximum of 13 persons. 3. Reservation of the Facility takes place via the booking portal www.airbnb.com under the conditions specified by the portal. 4. The Guest shall not be invoiced by the Lessor for the stay in the Facility. 5. The basis for transferring the Facility shall be presentation of the identity document of the Guest and the persons included in the reservation. 6. Unless the Parties have agreed otherwise, during the handover of the Facility the keys, information on the equipment and the manner of using the devices located within the Facility shall be provided by the owner or a person authorised by the owner. In the event of loss, misplacement or destruction of keys the Guest shall be obliged to pay an additional fee of PLN 500.00. 7. A first aid kit is located in the main room to which everyone has access. § 2 USING THE FACILITY 1. The Facility may be used only by persons who have made a reservation via the booking portal. It is not allowed to accommodate more people than declared in the Agreement. 2. Children under 13 years of age must be supervised by adults at all times when staying at the Facility. The children’s legal guardians are responsible for the children’s behaviour, including any damage or harm done. 3. Unless agreed otherwise, 1 dog up to 10 kg is allowed on the premises 4. Due to the family character of the Facility, the Lessor does not consent to the Guest organising parties, events or meetings for more persons than declared when booking the Facility, in particular stag and hen parties. For a breach of this prohibition the Guest shall be obliged to pay the Lessor a contractual penalty of PLN 2,000.00 (two thousand zlotys) for each such breach of the aforementioned prohibition. 5. We ask not to disturb the peace of the Facility’s neighbours and to observe quiet hours 6. The Guest shall be obliged to immediately inform the Lessor of any damage caused by the Guest or persons for whom the Guest is responsible, as well as damage caused by animals staying in the Facility. The Guest shall also be obliged to immediately inform the Lessor of any damage found on the premises of the Facility and not caused by the Guest; should the Guest fail to notify the Lessor of such damage, the Guest shall be fully liable for such damage on a strict liability basis as of the moment it is found by the Lessor. Guests of the Facility shall be materially liable for any damage, loss or destruction of equipment and technical devices caused by them or by their visitors. 7. The Guest shall be obliged to use the Facility in accordance with its intended purpose, take care of its technical condition, maintain the Facility in an appropriate state, take care to observe the principles of good neighbourhood and comply with house rules. The Customer is obliged to keep the garden and the farmyard in order and to use them in accordance with their purpose (plants, equipment). Guests of the Facility are requested not to walk in the living room, mezzanine and sleeping areas of the house wearing shoes used outdoors or high-heeled shoes. 8. We ask you to leave the house after your stay in the same tidy condition as at the time of check-in, except for minor signs of cultural abuse. All necessary equipment and cleaning products are on site. If the accommodation is left in a condition that requires more than standard cleaning to restore it to the same condition as at the time of check-in, the intermediary is entitled to charge the Guest an additional cleaning fee. 9. The communal waste is to be segregated by the Guest. 10. The sink is not equipped with a grinder. It is forbidden to throw food leftovers into the sink. Food leftovers should be secured and disposed of in a way that does not allow access of animals. 11. The Customer is obliged not to take any pieces of equipment from the Facility. 12. 12. Smoking and e-cigarettes are strictly forbidden inside the Facility in all rooms, except for the places designated for that purpose outside the building. Violation of the ban is subject to a fine of PLN 1000 for each case of ban violation, plus possible costs of replacing elements of equipment and furnishings of the Facility soaked in smoke. 13. Each time the Guest leaves the Facility during their stay, the Guest is obliged to secure it by closing the entrance door, balcony door and windows, and by turning off the hob, oven and other working electrical appliances. 14. Guests are required to strictly comply with fire safety regulations and rules. There is a fireplace with an insert in the cottages. The fireplace must always be used as intended. The fireplace insert must always be closed tightly. It is not allowed to leave the fireplace unattended. 15. During the Customer’s stay at the Facility there are no cleaning services or replenishment of chemicals and toiletries. 16. The Facility is equipped with wireless Internet access – Wi-Fi. 17. The Customer should use the household appliances as well as other devices in accordance with their intended use, while observing general safety rules. 18. The car park is intended for customers only. The parking is free of charge and unguarded. The Lessor is not responsible for the vehicles and property left in them. There is no accepted electric cars charging unless agreed otherwise. For a breach of this prohibition the Guest shall be obliged to pay the Lessor a contractual penalty of PLN 200.00 (two houndret zlotys) for each such breach of the aforementioned prohibition. 19. The facility is monitored from outside. 20. Barbecuing is allowed on the premises and bonfires are allowed only in designated areas (grill, fireplace). 21 It is forbidden to leave a lit barbecue or fireplace unattended, the fireplace must be cleaned up after the barbecue or bonfire is finished. Wood is available at the Property for a fee in accordance with the rules set forth in para. 28 below. Barbecue users are required to leave the barbecue clean after the barbecue is completed. It is prohibited to use the barbecue under the pergola or at the facade of the house. Guests are required to turn off the gas cylinder after each use of the grill. In the event of a gas shortage, the gas cylinder shall be replaced ONLY by the host at the request of the Guest. 22. The Customer shall bear full liability for damage or loss of elements of the Facility or swimming pool equipment. In the event that the contractual penalties stipulated herein do not cover the full damage, the Lessor shall be entitled to seek additional compensation on general principles. 23. In the event of a gross breach of the Regulations by the Guest, the Lessor shall be entitled to withdraw from the contract with immediate effect. In such a case the Guest shall be obliged to vacate the Facility immediately. Any fees in this situation shall not be refundable. 24. The Lessor shall not be liable for Guest’s belongings/properties left in the rooms and on the premises of the Facility, in particular for valuables. 25. The Lessor is not responsible for temporary inconvenience caused by independent suppliers, e.g., temporary lack of electricity, Internet, television. 26. The Lessor shall not be liable for any damage to property or personal injury suffered by the Guest or any third party during the performance of the contract, resulting for reasons for which the Lessor is not responsible in accordance with generally applicable law. Within the scope permitted by legal regulations, the total liability of the Lessor for the damage of the Guests and third parties shall be limited to the actual damage and may not in total exceed the amount of the remuneration of the Lessor for the stay of the Guest(s) in the Facility. 27. CHARGE FOR FIREPLACE OR HEARTH WOOD. We provide our guests with 2 prepared baskets of wood free of charge. Each additional basket of wood used is subject to an additional fee of 50 PLN. Wood can be collected in the woodshed next to the building. § 3 USE OF THE SWIMMING POOL 1. In the period from 1 May to 30 September the use of the pool is free of charge and possible 24 hours a day. The pool is not guarded. Guests use the pool at their own responsibility and risk and minors use the pool only under constant supervision of their adult carers. The Landlord is not responsible for children left unattended in the Facility and the pool. In a swimming pool the sole responsibility for children and youth under 18 years of age rests with their parents or carers. 2. The Lessor accepts no responsibility for injuries or damage to the Guest’s health resulting from their use of the pool. 3. Before entering the pool and starting to use the pool one should become familiar with these regulations and adhere to them during the entire period of using the pool. 4. It is absolutely forbidden to a) bringing in glass containers and vessels, sharp instruments and other, dangerous objects, b) to bring in, consume and serve foodstuffs, alcoholic beverages, drugs and other intoxicants, psychotropic drugs, etc. c) presence of animals, d) presence of persons who have consumed alcohol, drugs or other intoxicants, e) to run around in the surroundings, access ways and push other users into the water, jump into the water, f) climb on railings, pool frames and other equipment for other purposes, g) destroy and damage the pool and its equipment, in particular disassemble or unscrew elements of the pool (profiles) or filtration system, h) to throw dishes, food leftovers and any foreign objects into the water, i) it is prohibited to chew gum in the pool, j) pollute the pool water, k) carry out cosmetic treatments, l) use electrical appliances, m) smoking, n) indecent behaviour, or behaviour generally considered to be indecent or offensive, o) users of the pool must not cause situations that endanger the safety of those present in the pool. 5. The pool is 150 cm deep. 6. Entry into and exit from the pool is permitted only using the ladder. One person only. 7. Before entering the pool, flip-flops, goggles and all metal objects that can damage the pool membrane should be removed. 8. Every user of the pool is obliged to wash their whole body before entering the pool. 9. It is forbidden to use the pool for persons whose signs indicate: skin diseases, ringworm, papilloma, erythema, rosacea, etc, open cuts, infectious diseases, difficult-to-heal wounds, lack of personal hygiene, epilepsy, clean intravenous injections on upper limbs, breathing difficulties, balance disorders, aggressive behaviour, are allergic to disinfectants, chlorine or pool chemicals, have diseases of the excretory system, suffer from diseases related to circulatory insufficiency, with medical contraindications. 10. Persons with unstable health condition and pregnant women should use the pool with special caution (or after consultation with their doctor). 11. The Lessor is not responsible for the health consequences of their stay in the pool. 12. Any comments regarding the pool must be immediately reported to the Landlord. 13. The Lessor must be notified immediately of any safety or damage to the pool. 14. The Lessor shall not be liable for accidents caused by failure to observe the pool regulations § 4 RODO In accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter RODO), we inform you that: a) the Administrator of the Guest’s personal data is Marta Piętka, address for delivery 36-030 Błażowa, 759c Futoma Street, Poland. b) Guest’s personal data shall be processed: • in connection with the performance of the contract, for the purpose of providing services, on the basis of Article 6(1)(b) RODO, • in connection with the video surveillance system – to ensure the security of persons and property on the premises of the Facility, pursuant to Article 6(1)(f) RODO. c) Data will only be disclosed to entities authorised to process personal data which serve the administrator or its subcontractors and recipients authorised by law. d) The Guest’s personal data will be stored for a period: • in connection with the performed contract i.e. provision of services – the statute of limitations for claims under the performed contract, • in connection with the video surveillance system for a period of 30 days. e) The Guest has the right to access, rectify, delete, limit processing and transfer his/her data, as well as the right to object to processing and to withdraw consent to data processing at any time without affecting the legality of processing carried out on the basis of consent before its withdrawal. In order to exercise the aforementioned rights, a request must be sent in writing or electronically to the data controller’s address f) The Administrator will exercise the indicated rights if there are no circumstances entitling the Administrator to process them, of which the Guest will be informed. g) The Guest has the right to lodge a complaint to the supervisory authority if he/she considers that the processing of his/her personal data violates data protection regulations. h) Providing personal data by the Guest is voluntary, however, it is necessary for the above mentioned purpose of processing. i) The Guest’s data will not be transferred to third countries, nor will it be processed in an automated manner. § 5 FINAL PROVISIONS 1. Each Guest is obliged to become familiar with the rules of the Facility. 2. Ignorance of these rules does not exempt from compliance. 3. The Regulations are binding for everyone staying at the Facility without exception. 4. The Regulations are available for inspection in the common lounge. 5. Making a reservation is tantamount to accepting the above rules. 6. In matters not regulated by the provisions of the Civil Code. 7. Any disputes related to the Guest’s use of the Facility shall be settled by the common court in Katowice, according to the Polish procedural law.

Przed wejściem do Gorącej Balii należy zapoznać się z regulaminem. Przy korzystaniu z Gorącej Balii należy bezwzględnie stosować się do regulaminu korzystania z Gorącej Balii, poleceń oraz informacji udzielanych przez gospodarzy.
1.Gorąca Balii jest integralną częścią W Matulniku i na jej terenie obowiązują przepisy niniejszego Regulaminu.
2.Przed wejściem do Gorącej Balii należy zapoznać się z regulaminem.
3.Chęć pierwszego użycia bani należy dokonać najpóźniej w dzień poprzedzający planowane korzystanie z niej. W celu skorzystania z balii należy taką chęć zgłosić odpowiednio wcześniej balia będzie przygotowywana jeśli będzie to możliwe.
4.Balia przeznaczona jest maksymalnie dla 6-8 osób.
5. Przez resztę pobytu dostępne jest drewno do samodzielnego rozpalenia.
6. Balia nagrzewa się ok. 3-5 godzin.
7. W przypadku pytań dotyczących rozpalenia balii prosimy o kontakt z gospodarzem
8. Z Gorącej Balii mogą korzystać wyłącznie osoby całkowicie zdrowe.
9. Z Gorącej Balii mogą korzystać osoby pełnoletnie. Osoby niepełnoletnie mogą korzystać z Gorącej Balii tylko i wyłącznie w towarzystwie i na odpowiedzialność dorosłego opiekuna.
10. Osoby przebywające w Gorącej Balii deklarują pełną zdolność fizyczną i zdrowotną do korzystania z tego typy zabiegów i ponoszą odpowiedzialność za stan swojego zdrowia.
11. Zobowiązuje się użytkowników Gorącej Balii do przestrzegania porządku i utrzymania czystości użytkowanej przestrzeni
12. Nie należy dotykać elementów pieca w Gorącej Balii tych wystających ponad powierzchnie jak i tych zanurzonych w wodzie, mogą być one bardzo gorące i może dojść do poparzenia!!!
13. Przed wejściem do Gorącej Balii należy wziąć kąpiel z użyciem mydła w celu usunięcia z wszelkich kosmetyków i zanieczyszczeń.
14. W Gorącej Balii nie należy przebywać w okularach i szkłach kontaktowych.
15. Z Gorącej Balii należy korzystać w kostiumie bawełnianym.
16. Przed wejściem do Gorącej Balii należy zdjąć wszystkie przedmioty metalowe, gdyż mogą stać się przyczyną poparzeń ciała.
17. W Gorącej Balii przebywamy tak długo, jak długo czujemy się tam przyjemnie i komfortowo. 18. Zgodnie z przyjętymi zwyczajami w Gorącej Balii nie należy przeszkadzać innym gościom rozmową itp.

21. Do korzystania z Gorącej Bali nie należy przystępować na czczo lub po zbyt obfitym posiłku (gorących kąpieli w bali należy zażywać jedną lub dwie godziny po posiłku – zależnie od obfitości). Z Gorącej Bali nie powinno się również korzystać bezpośrednio po wzmożonym wysiłku psychicznym czy fizycznym lub kiedy nie jest się w pełnej dyspozycji fizycznej lub psychicznej. Przed kąpielą ani w czasie jej trwania bezwzględnie nie powinno się pić napojów alkoholowych, pragnienie możemy gasić wodą, herbatami ziołowymi lub sokiem.
22. W Gorącej Balii i przy niej należy poruszać się bardzo ostrożnie, gdyż Balia i schodki mogą być śliskie.
23. Przed skorzystaniem z bali należy mieć pewność, czy jest to dla nas bezpieczne oraz czy istnieją choćby najmniejsze przesłanki, ażeby z niej nie skorzystać, dlatego zaleca się zasięgnięcie porady lekarskiej odnośnie ewentualnych ograniczeń w korzystaniu z Gorącej Balii spowodowanych stanem zdrowia.
24. Z Gorącej Balii mogą korzystać osoby zdrowe lub osoby, których dolegliwości nie stanowią przeciwwskazań do korzystania z Gorącej Balii.
25. Z Gorącej Balii korzystać nie mogą osoby: – Chore na serce, nadciśnienie i z chorobami naczyń krwionośnych; – Chore na tarczycę, klaustrofobię, epilepsję, stany reumatyczne, nowotwory, ostre infekcje i stany astmatyczne; – Kobiety w okresie ciąży oraz w czasie menstruacji; – Osoby starszym, osłabionym oraz w stanie intoksykacji. – osoby, które mają inne przeciwskazania wynikające ze stanu ich zdrowia.
26. Korzystanie z Gorącej Balii odbywa się na własną odpowiedzialność użytkownika.
27. Dzieci w wieku od lat 4 do lat 18 mogą korzystać z obiektu tylko i wyłącznie pod stałą opieką rodzica bądź opiekuna, na ich odpowiedzialność. Dzieci poniżej 4 lat nie mogą korzystać z obiektu w ogóle.
28. Na teren Gorącej Balii zabrania się: − wchodzenia w ubraniu oraz obuwiu, − wykonywania zabiegów kosmetycznych, − hałasowania oraz głośnego prowadzenia rozmów, − wnoszenia naczyń, jedzenia i wszelkich przedmiotów obcych, − wnoszenia napojów alkoholowych, − wnoszenia przedmiotów szklanych, ceramicznych i ostrych przedmiotów. − nie obyczajnego zachowania, bądź zachowania uznanego powszechnie za nieprzyzwoite lub obraźliwe, − palenia tytoniu i innych substancji, palenia e-papierosów, zażywania narkotyków czy innych substancji psychoaktywnych, − niszczenia i uszkadzania wyposażenia.
29. Rodzice i opiekunowie prawni w ramach obowiązku nadzoru nad dzieckiem odpowiadają za wszelkie szkody spowodowane przez podopiecznych, którzy nie ukończyli 18 roku życia .
30. Nie wolno wchodzić do Gorącej Balii po alkoholu, narkotykach lub zażyciu silnie działających leków.
31. Nigdy nie należy spać w Gorącej Balii. W Gorącej Balii należy przebywać w towarzystwie drugiej osoby, która może udzielić pomocy w przypadku zasłabnięcia.
32. Korzystanie z Gorącej Balii jest równoznaczne z tym, że osoba zapoznała się i akceptuje wszystkie powyższe punkty regulaminu.

(11) The users of the Hot tub are obliged to keep the area used clean and tidy.
(12) Do not touch the parts of the furnace in the Hot tub that are protruding above the surface and those that are immersed in water, as they can be very hot and burn!!!
(13) Before entering the Hot Tub you should take a bath with soap in order to remove all cosmetics and impurities.
(14) Do not stay in the Hot Tub wearing glasses or contact lenses.
(15) The Hot Tub must be used in a cotton costume.
(16) Remove all metal objects before entering the Hot Tub as they may cause burns.
(17) You should stay in the Hot Tub as long as you feel comfortable there.
(18) It is customary not to disturb other visitors to the hot tub with conversation etc.
(19) Before getting dressed, spend some time in the hot tub rest for a while so that your heart rate returns to normal. He recommends drinking water to restore the fluid balance in the body.
(20) Staying in a heated Hot Tub for an extended period of time causes your body temperature to rise, which can be dangerous to your health.
(21) the Hot Tub should not be taken on an empty stomach or after a meal that is too large (the Hot Tub baths should be taken one or two hours after a meal – depending on how large the meal is). The Hot Tub should also not be taken immediately after intense mental or physical exertion or when you are not in full physical or mental shape. Absolutely no alcoholic beverages should be consumed before or during the bath; you can quench your thirst with water, herbal teas or juice.
(22) In and around the hot tub, you should move very carefully as the tub and steps can be slippery.
(23) Before using the hot tub you should be sure that it is safe for you and that there is even the slightest reason why you should not use it, therefore it is advisable to seek medical advice on any restrictions on the use of the hot tub due to a medical condition.
(24) The use of the Hot Tub is only possible for persons in good health or persons whose ailments do not represent a contraindication for the use of the Hot Tub.
(25) The Hot tub may not be used by persons with: – Those suffering from heart disease, hypertension and vascular diseases; – Those suffering from thyroid disease, claustrophobia, epilepsy, rheumatic conditions, tumors, acute infections and asthmatic conditions; – Pregnant and menstruating women; – The elderly, the weakened and those in a state of intoxication. – Persons who have other contraindications due to their state of health.
(26) The use of the Hot Tub is at the user’s own risk.
(27) Children between the age of 4 and 18 may use the facility only under the constant supervision of a parent or guardian and at their own risk. Children under the age of 4 may not use the facility at all.
(28) It is not permitted to enter the Hot Tub: – to enter wearing clothes and shoes, – to carry out cosmetic procedures, – to make noise and carry out loud conversations, – to bring in dishes, food and any foreign objects, – to bring in alcoholic beverages, – to bring in glass, ceramic and sharp objects. – indecent or offensive behaviour, – smoking and other substances, smoking e-cigarettes, using drugs or other psychoactive substances, – damaging or destroying equipment.
(29) Parents and legal guardians, as part of their duty to supervise their children, are responsible for any damage caused by wards who are under 18 years of age .
(30) Do not enter the Hot Tub after drinking alcohol, taking drugs or strong medicines.
(31) You should never sleep in the Hot Tub. In the Hot Tub you should be accompanied by another person who can provide assistance in case of fainting.
(32) By using the Hot Tub, the person has read and accepts all of the above points of the Rules and Regulations.
